When President Obama came into office in 2009 he promised to shut down the Guantanamo Bay detention camp and end the extra-judicial system that his predecessor had created to imprison terrorist suspects without trial, often without even filing charges. He has broken that promise.

Mr. Obama failed to close down Guantanamo through a combination of inaction and political ineptness. His administration made significant changes to President George W. Bush’s military tribunals, but at the same time left the door open to the concept of indefinite detention.

Now, Congress seems to be on the verge of passing a law that would make indefinite detention a permanent part of the American way.

Here’s what’s going on:

The Senate is debating the National Defense Authorization Act, which includes a series of provisions that mandate military interrogation and detention for any suspected member of Al Qaeda, and authorize indefinite detention of terrorist suspects without trial. (The law is written so broadly that parts of it could also cover U.S. citizens.)

The provisions were co-sponsored by Senators Carl Levin, Democrat of Michigan, and John McCain, Republican of Arizona, both of whom should know better. Their excuse was that some Republicans had proposed worse rules. But the smart response to that situation would have been to block faulty legislation outright, not to make a really bad deal.

A deal, by the way, that Senator Patrick Leahy, the Vermont Democrat who heads the Senate Judiciary Committee, said was hashed out behind closed doors without consultation with his committee, or the Intelligence Committee, or the Defense Department, the F.B.I. or the intelligence community.

These new policies would all but remove the F.B.I., federal prosecutors, and federal courts from the business of interrogating, charging and trying suspected terrorists. Never mind that they have a track record of doing just that, legally and in the open. Instead, it would put those functions in the hands of the military, which is not very good at it, and doesn’t want to do it…

Monday, Oct. 10: World Day Against the Death Penalty

  On Monday, October 10 — World Day against the Death Penalty — continue the fight for all the Troy Davises of the world.

Dear Mitchell,

The state of Georgia shocked the world when it ended Troy Davis’ life on September 21, 2011. In the face of significant doubts, Georgia proceeded with the execution of someone who may well have been innocent.

But in the midst of this horrible tragedy, we have seen an unprecedented surge of energy to end the death penalty. Troy Davis put a face on the death penalty in the U.S. — making it painfully clear why this flawed and horrific system must be abolished at once.

It was Troy’s final wish for us to keep fighting for all of the other Troy Davises on death row. And on Monday, October 10 — World Day against the Death Penalty — we’ll use our renewed energy and passion to take aim at doing just that.

We believe the next Troy Davis could be Reggie Clemons in Missouri.

Elements of Reggie’s case may sound familiar:

  • No physical evidence linking Clemons to the crime
  • Two highly questionable witnesses – both of whom were suspects in the crime
  • Alleged police coercion
  • Racial bias – evidenced by the jury selection where blacks were disproportionately dismissed

But the biggest similarity between the cases of Troy Davis and Reggie Clemons — overwhelming doubt! .

We hear a lot about “shared sacrifice” and belt-tightening out of Washington, but as billionaire investor Warren Buffett noted recently:

“Our leaders have asked for ‘shared sacrifice.’ But when they did the asking, they spared me…and while most Americans struggle to make ends meet, we mega-rich continue to get our extraordinary tax breaks.”1

As complicated as some want to make it, this issue is very simple. In a time of economic crisis, it’s both healthy for our democracy and fundamentally fair to ask the super rich to pay more.

Senator Bernie Sanders has a bill to do this and make millionaires and billionaires pay their fair share. But Senate Majority Leader Harry Reid has yet to call a vote on it.

One of the main drivers of our federal deficit are the Bush tax cuts, which have driven down tax rates for the wealthiest Americans to the lowest levels we’ve seen since the 1950s.

Tax rates for the richest Americans have fallen sharply despite the fact that taxing millionaires and billionaires is wildly popular, and the cost of not taxing them extremely high. The Sanders bill alone would bring in an additional $50 billion a year in revenue.

When someone like billionaire investor Warren Buffett says that he and his friends “have been coddled long enough by a billionaire-friendly Congress,”2 people pay close attention. And with Washington focused on what to cut and by how much, Mr. Buffett asking for Congress to raise his taxes represents an important opportunity.

This is a rare moment to inject common sense into the debate over budgets and get senators on the record about being for or against record low tax rates enjoyed by billionaires like Mr. Buffett.

With the creation of a new twelve member Super Committee empowered to fast-track through Congress budget-slashing legislation that cannot be amended, it’s more important than ever that we pressure our representatives to deal with the crisis caused by their inability to end the Bush tax cuts and bring back rational taxation rates for the richest Americans.

And before the congressional Super Committee issues a draft of its budget plan, we need all senators to go on the record about whether they support or oppose the simple notion that the super rich need to pay their fair share. This will create much needed momentum to help Democrats on the Super Committee hold the line on our demands for revenue increases.

Republican hostage-taking and other deeply undemocratic tactics by members of both parties have left us with a budget process that is broken, and as a result most senators avoid taking a stand on important issues like whether we should raise taxes on the very richest among us.

But in the face of massive budget shortfalls, and with a billionaire like Warren Buffett literally asking for it, there’s no excuse for Congress not to vote on taxing millionaires and billionaires.

Tell your representative not to weaken the Clean Water Act

Just decades ago, America’s rivers were so polluted that they actually caught fire. The Clean Water Act changed that by making clean water a federal responsibility, empowering the Environmental Protection Agency to set national standards for protecting water from pollution. Now industry-backed members of Congress are attacking these fundamental protections with a new bill that would undermine national clean water standards and could loosen regulations on mountaintop removal mines, sewage treatment plants and other polluters.

This dirty water bill would drastically weaken federal oversight over water pollution limits, depriving Americans of minimum health and environmental standards that apply no matter where you live or travel in the nation. States alone cannot effectively prevent polluters from dumping much more pollution in their waters than is currently allowed under EPA standards, potentially polluting the waters of neighboring states and undermining the overall effectiveness of clean water protections.

While states appropriately have a primary role in implementing clean water protections, the law does not function effectively without a level playing field that ensures people have a minimum level of clean water and safe drinking water regardless of what state they live in.
